You acknowledge that adventure travel and the products and services offered by the tour operator may involve a significant risk to your health and safety. By traveling with the tour operator, you acknowledge that you have considered all potential health and safety risks. You hereby assume responsibility for all such risks and release Tour Operator from all claims and causes of action arising from loss, damage or injury or death resulting from risks associated with travel, including but not limited to adventure travel, visiting foreign destinations and participating in adventure activities as included in itineraries or otherwise provided by Tour Operator.

You acknowledge that the extent and nature of the personal risk involved will depend on the product(s) or service(s) booked and the location(s) where a product or service is operated, and that there may be a significant degree of personal risk associated with participation, including but not limited to physical activities, travel to remote locations, transportation by watercraft, participation in "extreme sports," water sports, hiking or other high risk activities, or travel to countries with developing infrastructure. Hygiene, accommodation and transportation standards in certain countries where tours take place are often lower than the standards you can reasonably expect in your home country or region. You agree that Tour Operator is not responsible for providing information or guidance regarding local customs, weather conditions, specific safety concerns, physical challenges or applicable laws in any location where a tour, product or service is conducted. You acknowledge that you have considered the potential risks, hazards and challenges, as well as your own personal abilities and needs, and you expressly assume the risks associated with travel under such conditions.

You must strictly comply with all applicable laws and regulations of all countries and regions at all times. If you fail to comply with the foregoing or commit any unlawful act during the tour or if, in the opinion of the tour operator (reasonable conduct), your conduct causes or is likely to cause danger, distress or substantial annoyance to others, this will be The tour operator may immediately cancel your tour arrangements for any products or services at your expense and without liability on the part of the tour operator. You are not entitled to reimbursement for any unused or missed services or expenses incurred as a result of the termination of your travel arrangements, including but not limited to return travel, lodging, meals and incidental expenses.

You are responsible for all costs (including repair, replacement and cleaning charges) incurred by the tour operator or the tour operator's suppliers for property damage, destruction or theft caused by you during a tour. You agree to report any pre-existing damage to a representative of the tour operator and the staff of the accommodation, transportation service or facility as soon as possible after discovery.

You agree to take all prudent measures with respect to your own safety during the Tour, including, but not limited to, the proper use of safety devices (including seat belts, harnesses, flotation devices, and helmets) and compliance with all posted signs and oral or written health and safety warnings. Neither the Tour Operator nor its Third Party Providers (as defined herein) shall be liable for any loss or damage resulting from your failure to follow safety instructions or warnings.

You agree to direct all complaints to Tour Operator as soon as possible to allow Tour Operator to adequately address any such complaint. You agree to inform your tour guide, another representative of the tour operator or the tour operator's customer service department directly. The tour operator assumes no liability for complaints that are not properly brought to the tour operator's attention and cannot resolve or attempt to resolve complaints until proper notice is given. Any claim after the completion of a tour must be received in writing by the tour operator within 30 days after the last day of travel of the booking in question.
